These terms cover your use of StalkMail. By creating an account or sending email through the service, you agree to them.
We have kept them as plain as we can. If something is unclear, ask us before you rely on it.
Your account
You need an account to use StalkMail. You are responsible for keeping your sign-in method and API keys secure, and for everything done through your account.
You must be old enough to enter a contract in your jurisdiction, and you must give us accurate information.
Acceptable use
You may only email people who have given you permission to email them. Bought, rented, scraped and appended lists are not allowed.
The acceptable use policy is part of these terms and lists the behaviour that can get an account suspended.
Plans, billing and usage
Plans are billed in advance, monthly or yearly, and include a monthly email allowance and a contact limit. Emails are counted when we hand them to the delivery provider.
If you reach your email allowance, campaigns pause until the allowance resets or you upgrade. Signups and confirmation emails continue.
Upgrades take effect immediately and are prorated. Downgrades take effect at the next billing period. Prices are in US dollars and exclude taxes we are required to collect.
Cancellation and refunds
You can cancel at any time. Your plan stays active until the end of the period you paid for, then sending stops. Your data remains available for a period after cancellation, as described in the privacy policy.
If something is broken on our side, contact us within 14 days of a charge and we will make it right.
Your content
You keep ownership of the content you create and the subscriber data you upload. You grant us the limited licence needed to store, process and deliver it.
You are responsible for having the rights to the images and text you send, and for complying with the anti-spam and privacy laws that apply to you.
Our service
We work to keep StalkMail available and reliable, but we do not promise uninterrupted service. We may change features, and we will give notice before a change materially reduces what you paid for.
We may suspend an account that breaks these terms, threatens deliverability for other customers, or is used for abuse. Where it is safe to do so, we will tell you why and how to fix it.
Liability
To the extent the law allows, our total liability for a claim relating to the service is limited to the amount you paid us in the three months before the claim.
We are not liable for indirect or consequential loss, including lost profits or lost data, except where the law does not allow us to exclude it.
Changes and governing law
We may update these terms. If a change is material, we will notify account holders by email or in the dashboard before it takes effect.
These terms are governed by the laws of the jurisdiction in which the operating company is registered. The specific jurisdiction will be confirmed before general availability.
